TERMS & CONDITIONS OF PARTICIPATION OUTDOOR PLANET
1. Registration
You can register your trip with us by phone,in writing or in person By booking on the basis of our prospectus you are entering into a travel contract with ourselves.The contract becomes binding at the point we accept your application in the form of our booking confirmation (written or oral).
If the content of the booking confirmation differs from your application, it represents a new offer from us, to which we are bound for 14 days.
The contract becomes binding when you tell us of your express acceptance within the deadline.
For short notice bookings (10 days before departure) we will, after taking your payment, send the booking confirmation immediately.
The applicant is explicitly assured that a reservation has been made in the name and authority of the registered traveller
2. Scope
The scope of contractual services will be outlined in the booking confirmation. In the absence of such written confirmations as mentioned in the prospectus, the scope applies as specified in the prospectus prices.
3. Cancellation by the customer
You can withdraw from the trip at any time prior to departure. In your own interest and to avoid misunderstandings, we strongly recommend you declare the cancellation in writing.As compensation for travel arrangements and expenses we may, depending on the proximity of the cancellation to the time of departure, require a percentage payment of the price subject to the following outline:
10% up to 30 days before departure
15% from 29 days - 22 days before departure
25% from 21 days - 15 days before departure date
40% from day 14 - 7 days before departure date
50% 6 days before departure
100% when cancelled by non-appearance on the day of travel.
4. Substitute
Up until departure you may allow a third party to undertake the journey in your place. Any resulting additional costs shall be charged to you.We may object to the change of persons, if the third party does not fulfil the travel requirement ratios, or precludes legal arrangements
5. Unused services
If the travel participant does not use the (individual) travel services for whatever reason, there is generally no refund of the tour price.
It is in our discretion in cases of hardship (illness, accident etc) to award vouchers for individual and failed travel services, provided we have received notice of cancellation in due time. We recommend taking out travel cancellation insurance.
If the event participants do not appear at the event at the agreed time or do not arrive in time time, there is no entitlement to a refund of ( part of ) the price.
Wherever possible, we try to arrange for travel on an alternate date. You will be liable for any additional costs which ensue.
6. Cancellation & Termination by the organizer
We may withdraw or cancel the contract after departure if the traveller proceeds to disturb the execution of the trip despite our agreements, or if they violate the contract to such an extent that immediate termination of the contract is justified.
If a participant is unable to cope due to a miscalculation of their capabilities, the same applies. We will cancel the contract up to one week prior to departure if an advertised or officially specified minimum number of participants is not reached.
7. Termination due to force majeure
If the trip is impeded or endangered due to circumstances unforeseen in the contract (force majeure), or customer safety is no longer guaranteed, after exploring possible alternative dates or by proposal of a replacement program of equal value, both you and we may terminate the agreement.
Upon termination before departure for the aforementioned reasons the full travel price paid will be refunded and no other claim will exist.
If the aforementioned reasons occur after commencement of the journey, the travel contract may be terminated after exploring possible alternative dates or an equivalent replacement program on both sides.
If the contract is cancelled, we can demand reasonable compensation for the services already rendered or for completion of your journey.
8. Conditions of Participation
Good health and good physical condition as a prerequisite for participation in our activities.
The participant agrees to inform the organizers about known health problems.
For all activities associated with water, such as canyoning and rafting, all participants must have sufficient swimming skills.
Participation in activity while under the influence of alcohol or drugs, after taking psychotropic drugs or similar is not permitted.
It is the duty of the customer to abide by the terms and conditions and to adhere to the instructions of the organizer, guideand assistants at all times.
Failure to follow these means the participant may be excluded from the activity. If excluded prior to the activity, the cancellation policy applies.
If the exclusion occurs after the start of the activity, the customer has no right to a refund.
9. Liability, Limitation of Liability
We provide the contractually agreed travel services with the diligence of a prudent business.
All undertake to participate at their own risk, the organizer accepts no liability and will not be held liable for malice or gross negligence.
The fee includes only guiding and instruction. We limit our liability for whatever legal reason to three times the price of the service.
We are not liable for disturbances in connection with external services which have been simply arranged by ourselves.
In this case, the travel conditions of the respective organizer apply.
10. Cooperation
You are obliged to cooperate in disruptions to services under the statutory provisions, to avoid or minimize possible damages.
In particular, you are obliged to bring your complaints directly to us and to the attention of our staff.
We and our staff will endeavor to respond to this complaint, as far as we are able.
In the event you fail to make us aware of any defect, there shall be no claim to compensation or any reduction of the price.
11.Invalidity of any provision
If one or more of the provisions of the travel contract become wholly or partly ineffective, this does not invalidate the entire travel contract.
Rather, we are entitled to replace the invalid provision with a valid provision corresponding to the most far-reaching purpose of the invalid provision.
12. Exclusion of claims and limitation
You are expected to bring all claims for non-contractual performance of the tour to our attention within one month after the contractual completion of the journey.
After the deadline, you can make a claim if you were prevented from meeting the deadline through no fault of your own. All your rights from the travel contract expire after 6 months.
The period begins with the day on which the journey should end according to the contract.
If you have made such claims, the limitation period is suspended until the date on which we reject the claims in writing.
13.Applicable Law / Jurisdiction
The law of the Federal Republic of Austria is the only applicable legal authority for agreements and disputes between the customer and the organizer. The legal jurisdiction is Silz in Tirol
